We, the women of Flight PS752 victims’ families, honor the memory of our loved ones on International Women’s Day—lives taken by a deliberate missile strike in the skies of our homeland.

Our grief has not silenced us; we stand together to bring our cry for justice to the world.

We are the voices of women who have fallen victim to violence and oppression—women who have suffered in their homes, in prisons, in the streets, and even in the sky, victims of tyranny and injustice.

Mothers who saw their children drenched in blood, daughters whose dreams were buried with them, and sisters who are no longer with us, yet whose names will never be forgotten.

March 8th is not just a day for us; it is a commitment—to justice, to the fight for freedom, and to standing firm against oppression.

In memory of the women of Flight PS752, in memory of all women who have suffered violence, and in honor of those who have fought—and continue to fight—for freedom, we remain alive, and we carry on.

The judge wrote the following about the anniversary ceremonies and the Berlin demonstration:
"Mehrzad also raises concerns about expenses incurred on holding a ceremony in respect of the third anniversary of the downing of Flight PS752. While there is a suggestion that this ceremony served more as a political platform than a platform for seeking justice, there are no details to back this up. The Association indicated that it held this ceremony because it was the first opportunity for the families of victims to come together and see each other since COVID. The ceremony successfully brought together many of the country’s most prominent leaders including the Prime Minister, federal cabinet ministers and members of Parliament and renewed attention on the scale of the tragedy of Flight PS752.
[81] Notably, while there is reference to “huge expenses” there is not a single reference to a particular expenditure that was inappropriate or excessive.
[82] Mehrzad also makes reference to the costs associated with a Director attending the Berlin rally but as I noted above, this was within the Board authority. Mehrzad has not demonstrated any concerns with any particular expenditures."
The judge wrote the following about the financial matters of the Association:
"There is simply insufficient evidence before me to show there is any real concern that the money raised by the Association has been used for improper purposes. Mehrzad’s Failure to Take Reasonable Steps to address his concerns."
Conclusion:
"Therefore, the Application is dismissed."

[36] In my view the Board’s decisions as to how the Association will achieve its Purposes, and its decision that it will not provide the kind of direct financial support that Mehrzad wants is a reasonable interpretation that falls within the business judgment rule and which is entitled to deference.”
The judge wrote the following about the Association's partisan or non-partisan activities in Canada:
“Although Mehrzad’s materials baldly allege that the members of the Board have political ambitions “to seek favours from or a political nomination to the Liberal party in the next federal election,” there is no evidence to back this up. There is also insufficient evidence to support the bald statement that the Association has been improperly supporting a particular party in Canada.”
The judge wrote the following about the Association's partisan or non-partisan activities within the Iranian community and the organization of global rallies:
“He complains that the Association has been involved with “Global Network Rallies, which is a Global Network formed in the wake of the Woman-Life-Freedom movement in Iran that arose after Mahsa Amini’s death after being beaten by the morality police. The goal of the Global Network group was to facilitate the organization of worldwide rallies to protest human rights violations in Iran.
[43] As a prominent and reputable non-profit organization within the Iranian diaspora, the Association undertook the formation and leadership of the Global Network group for two reasons.
First its contribution was seen as a moral obligation given the Association’s capabilities and structure. Second, there were obvious synergies between the core objectives of the Association for seeking truth and justice for the downing of Flight PS752 and the protests against human rights violations by the same regime. While the Association supported the Global Network to hold numerous rallies in countless cities around the globe, the Global Network also supported the core goals of the Association on many occasions such as rallies for Flight PS752 on the anniversaries.”
The judge wrote the following about the request to hand over the Association's membership list to the plaintiff:
"The Association provided evidence that the Iranian regime has been intimidating and harassing family members of those who died on Flight PS752. Many Iranians fear reprisals from the Iranian government. Accordingly, their anonymity in these circumstances is a reasonable concern for the Board to have. I note that some of the plaintiffs in the proceeding brought by
Mehrzad were anonymous. Belobaba J. issued a sealing order in respect of that proceeding because of such concerns. He found that there were “genuine and credible fear[s] of reprisal” in Canada."
The judge wrote the following about the allegation that some members of the Association are affiliated with the government:
"With respect to the argument that Mehrzad requires the register because there might be some members who are part of the Iranian regime, there is absolutely no admissible evidence to support this."
The judge wrote the following about the Association's hiring of consultants:
"The Association explained that it hired a consultant to assist it with its lobbying of the Canadian government. It felt that it required assistance that went beyond what it could achieve with only volunteers which included the Board. With the consultant’s assistance, it established deep connections with many relevant ministries and international bodies.

Report to the Public Regarding the Lawsuit Against the Association of Families of Flight PS752 Victims
Recently, a lawsuit filed by a member of the Association, alleging that the Association failed to adhere to its objectives, was decisively dismissed by a judge of the Ontario Superior Court. Now, with greater peace of mind, we can report to the public and provide a detailed explanation of this legal case that has been imposed on the Association of Families of Flight PS752 Victims for the past two years.
In the absence of independent media and in the absence of media outlets that feel responsible towards Iran's civil society, it has fallen upon us to strive for public awareness.
Mehrzad Zarei, one of the family members of the victims, who was intermittently a member of the Association during the first three years following the tragedy, and even when he was not a member, he received support from Association members for his individual campaign, requested financial assistance from us through his lawyer two years ago. According to the court ruling: "He asserts that the Association should be providing direct financial support to the members and that it should also fund his efforts to enforce the judgment he received against the Islamic Republic of Iran"
The Association of Families has never provided financial assistance to any family but has rather tried to utilize its financial resources for larger campaigns aimed at holding the Islamic Republic accountable for the crime it committed. We tried to explain this to him and his lawyer and sought to avoid, as much as possible, a legal confrontation between the Association and one of its members. However, almost immediately, a lawsuit was filed against the Association in the province of Ontario, Canada.
This case has gone through many ups and downs over the past two years. In addition to over a hundred thousand dollars in legal costs, it drained the time, energy, and peace of mind of the member families of the Association. Several individuals agreed to testify against the Association alongside him; their names and statements are documented in the lawsuit and are open to scrutiny by impartial media. Concurrent with this lawsuit, the Islamic Republic's television network launched a smear campaign against the Association, accompanied by a social media campaign with the same theme. Due to our commitment to confidentiality regarding court matters, we were unable to defend ourselves or raise public awareness. Opportunities that could have been used to counter the Islamic Republic were unfortunately spent on lengthy meetings and the preparation of documents for submission to the court.
Finally, on November 27, 2024, the court convened, and less than a week later, on December 3, 2024, the verdict was issued. Last week, the judge also ordered Mehrzad Zarei to pay approximately $60,000 to the Association to cover legal expenses. We have not yet made a decision on how to proceed with the enforcement of this ruling. However, in the continuation of this text, we present excerpts from Judge Papageorgiou's ruling and leave the judgment to you:
The judge wrote the following about financial assistance to families and the Association's campaigns:
“The Association has decided that it would fulfill the Purposes, not through the provision of financial support but through the following activities:
- a campaign to pressure the international community to bring those responsible to justice before the International Court of Justice, International Criminal Court, and International Civil Aviation Organization.
- annual memorial events to honour the memories of the victims and seek action from the government to continue to pursue the truth.
- holding rallies to demand action, which rallies have been attended by thousands of people.

«تا در انتخابات فدرال بعدی از حزب لیبرال امتیاز بگیرند یا نامزد سیاسی شوند»، هیچ مدرکی برای تأیید این ادعا وجود ندارد. همچنین، شواهد کافی برای تأیید این ادعای صریح که انجمن به‌طور نادرست از یک حزب خاص در کانادا حمایت کرده است، موجود نیست.»

قاضی در مورد فعالیت حزبی یا غیرحزبی انجمن در جامعه‌ی ایرانیان و برگزاری راهپیمایی‌های جهانی چنین می‌نویسد:

« او (مهرزاد) شکایت می‌کند که انجمن در تظاهرات «شبکه‌ی جهانی» مشارکت داشته است.
این شبکه‌ی جهانی در پی جنبش «زن، زندگی، آزادی» که پس از مرگ مهسا امینی بر اثر ضرب و شتم گشت ارشاد در ایران شکل گرفت، ایجاد شد. هدف این گروه تسهیل سازماندهی تظاهرات جهانی برای اعتراض به نقض حقوق بشر در ایران بود. 

انجمن به عنوان یک سازمان غیرانتفاعی برجسته و معتبر در میان ایرانیان خارج از کشور، به دو دلیل در شکل‌گیری و هدایت این گروه نقش داشت. 
نخست، این مشارکت با توجه به توانایی‌ها و ساختار انجمن، به‌عنوان یک وظیفه‌ی اخلاقی دیده می‌شد. 

دوم، هم‌افزایی آشکاری بین اهداف اصلی انجمن در زمینه‌ی جستجوی حقیقت و عدالت برای سرنگونی پرواز PS752 و اعتراضات علیه نقض حقوق بشر توسط همان رژیم وجود داشت. 
در حالی که انجمن از شبکه‌ی جهانی برای برگزاری تظاهرات متعدد در شهرهای بی‌شمار در سراسر جهان حمایت کرد، این شبکه‌ی جهانی نیز در مناسبت‌های زیادی مانند تجمعات سالگرد پرواز PS752 از اهداف اصلی انجمن پشتیبانی کرد.»

قاضی در مورد تحویل لیست اعضای انجمن به شاکی چنین می‌نویسد:

«انجمن شواهدی ارائه داده است که نشان می‌دهد رژیم ایران خانواده‌های جانباختگان پرواز PS752 را مورد ارعاب و آزار قرار داده است. بسیاری از ایرانیان از اقدامات تلافی‌جویانه‌ی دولت ایران بیم دارند. بنابراین، نگرانی هیئت مدیره درباره‌ی حفظ ناشناس‌ ماندن اعضا در این شرایط، منطقی است. لازم به ذکر است که برخی از شاکیان در شکایت مطرح‌شده توسط مهرزاد هویت خود را آشکار نکرده‌اند. قاضی بلوبابا برای این پرونده دستور مهروموم (sealing order) صادر کرد، زیرا او به این نتیجه رسیده بود که نگرانی‌های مطرح‌شده درباره‌ی انتقام‌گیری جمهوری اسلامی «واقعی و معتبر» هستند.»


قاضی در مورد ادعای حکومتی بودن برخی اعضای انجمن چنین می‌نویسد:

«در مورد ادعای مهرزاد که درخواستش برای گرفتن لیست اعضا به این دلیل بوده که ممکن است برخی از آن‌ها عضو رژیم [جمهوری اسلامی] ایران باشند، هیچ مدرک قابل قبولی وجود ندارد.»

قاضی درباره‌ی استخدام مشاورین توسط انجمن چنین می‌نویسد:

«انجمن توضیح داده است که برای کمک به ارتباط موثر با دولت کانادا، یک شرکت مشاور استخدام کرده است. انجمن بر این باور بود که برای دستیابی به اهداف خود، به کمکی فراتر از آنچه تنها با کمک داوطلبان و اعضای هیئت مدیره ممکن بود، نیاز دارد. با کمک این شرکت، ارتباطات عمیقی با بسیاری از وزارت‌خانه‌های مرتبط و نهادهای بین‌المللی برقرار کرد. همچنین، اعلام کرده است که این شرکت تنها ۵۰ درصد از هزینه‌ی معمول خود را دریافت کرده است. دستاوردهای این همکاری، گواهی بر ارزش این شرکت مشاور است.»

قاضی درباره‌ی مراسم‌های سالگرد و تظاهرات برلین چنین می‌نویسد:
«مهرزاد همچنین نگرانی‌هایی را درباره‌ی هزینه‌های برگزاری مراسم سومین سالگرد سرنگونی پرواز PS752 مطرح کرده است. اگرچه ادعا شده است که این مراسم بیشتر به‌عنوان یک پلتفرم سیاسی عمل کرده تا بستری برای پیگیری عدالت، اما هیچ جزئیاتی برای تایید این ادعا ارائه نشده است. انجمن اعلام کرده است که این مراسم را به این دلیل برگزار کرده که این اولین فرصتی بوده که خانواده‌های جانباختگان پس از دوران کووید می‌توانستند یکدیگر را ملاقات کنند. این مراسم با موفقیت، بسیاری از رهبران برجسته‌ی کشور، از جمله نخست‌وزیر، وزرای کابینه‌ی فدرال و نمایندگان مجلس را گرد هم آورد و توجهات را مجددا به ابعاد این فاجعه جلب کرد.

قابل توجه است که با وجود اشاره به «هزینه‌های کلان»، هیچ اشاره‌ای به هزینه‌ی خاصی که نامناسب یا بیش از حد باشد، نشده است.

مهرزاد همچنین به هزینه‌های مربوط به حضور یکی از مدیران انجمن در تجمع برلین اشاره کرده است، اما همان‌طور که قبلا ذکر شد، این تصمیم در حوزه‌ی اختیارات هیئت مدیره بوده است. مهرزاد هیچ نگرانی مشخصی را درباره‌ی هیچ هزینه‌ای اثبات نکرده است.»


قاضی در نهایت درباره‌ی مسائل مالی انجمن می‌نویسد:

«هیچ مدرک کافی در اختیار من نیست که نشان دهد نگرانی واقعی‌ در مورد استفاده‌ی نادرست از پول‌هایی که انجمن جمع‌آوری کرده است، وجود دارد. مهرزاد موفق نشده است که برای رسیدگی به نگرانی‌های خود در مسیر منطقی گام بردارد.

در مورد نگرانی‌های مربوط به شفافیت، انجمن گزارش‌های سالانه‌ای درباره فعالیت‌های مالی خود ارائه می‌دهد.»

نتیجه‌گیری:
«بنابراین، این درخواست رد می‌شود.»

گزارشی به مردم: شکایت از انجمن خانواده‌های پرواز

اخیرا شکایتی که یکی از اعضای انجمن با ادعای عدم پایبندی انجمن به اهداف خود مطرح کرده بود با قاطعیت از سوی قاضی دادگاه عالی انتاریو رد شد. اینک با فراغ بال بیشتری می‌توان به مردم‌ گزارش داد و موضوع یک پرونده‌ی حقوقی را که دو سال است به انجمن خانواده‌های پرواز تحمیل شده است به تفصیل توضیح داد.

در غیاب رسانه‌های مستقل و همچنین در غیبت رسانه‌هایی که نسبت به جامعه‌ی مدنی ایران احساس مسوولیت کنند این نیز بر دوش ما افتاده است تا در جهت روشن کردن افکار عمومی بکوشیم.

مهرزاد زارعی، یکی از اعضای خانواده‌های پرواز که در سه سال اولِ پس از این فاجعه مدتی عضو این انجمن بود و‌ مدتی نبود و آن‌گاه که عضو هم نبود از حمایت اعضای انجمن در کارزار انفرادی خود برخوردار بود دو سال پیش از طریق وکیل خود از ما تقاضای کمک مالی کرد. از حکم: «او تأکید دارد که انجمن باید حمایت مالی مستقیم به اعضا ارائه دهد و همچنین باید هزینه‌های تلاش‌های او برای اجرای حکمی را که علیه جمهوری اسلامی ایران دریافت کرده است تأمین کند.»

انجمن خانواده‌ها هرگز به هیچ خانواده‌ای کمک مالی نکرده بود بلکه تلاش کرده بود منابع مالی خود را در راه کارزارهای بزرگ‌تر به کار ببندد تا جمهوری اسلامی را نسبت به جنایت مرتکب شده‌اش پاسخگو کند. ما تلاش کردیم موضوع را برای ایشان و وکیل‌شان توضیح بدهیم و تا حد ممکن از روبرو شدن انجمن و یکی از اعضای آن در یک پرونده‌ی حقوقی بپرهیزیم اما تقریبا بلافاصله شکایتی از سوی ایشان علیه انجمن در استان انتاریوی کانادا ثبت شد.

افت و خیز بسیاری در این دو سال با این پرونده همراه بود که علاوه بر بیش از صد هزار دلار هزینه‌ی حقوقی، وقت و انرژی و آرامش خانواده‌های عضو انجمن را از آن‌ها گرفت. افرادی حاضر شدند در کنار ایشان علیه انجمن شهادت بدهند که نام و‌ گفتار آن‌ها در شکایت ثبت شده است و توسط رسانه‌های بی‌طرف قابل بررسی‌ست. همزمان با این شکایت، تلویزیون جمهوری اسلامی هم دست به بدنام‌سازی انجمن زد و کارزاری با همین مضمون در شبکه‌های اجتماعی دنبال می‌شد و ما به دلیل تعهد به محرمانه بودن موضوعات مطرح شده در دادگاه نمی‌توانستیم از خود دفاع کنیم و یا به روشنگری افکار عمومی بپردازیم. فرصت‌هایی که می‌توانست در ضربه زدن به جمهوری اسلامی استفاده شود متاسفانه صرف جلسات طولانی و تهیه‌ی مدارک جهت ارائه‌ به دادگاه شد. 

عاقبت در تاریخ ۲۷ نوامبر سال ۲۰۲۴ دادگاه تشکیل جلسه داد و کمتر از یک هفته‌ی بعد یعنی در سوم دسامبر ۲۰۲۴ حکم صادر شد. هفته‌ی گذشته نیز قاضی مهرزاد زارعی را موظف کرد حدودا مبلغ ۶۰ هزار دلار به انجمن بابت جبران هزینه‌های حقوقی بپردازد که ما هنوز درباره‌ی چند و چون اجرای آن تصمیمی نگرفته‌ایم اما در ادامه‌ی این متن فرازهایی از حکم قاضی پاپاجورجیو را می‌آوریم و قضاوت را به شما می‌سپریم:
قاضی درباره‌ی کمک مالی به خانواده‌ها و کارزارهای انجمن چنین می‌نویسد:

«انجمن تصمیم گرفته است که اهداف خود را نه از طریق ارائه‌ی کمک مالی، بلکه از طریق فعالیت‌های زیر دنبال کند:

- کارزاری برای تحت فشار گذاشتن جامعه‌ی بین‌المللی جهت محاکمه‌ی عاملان این جنایت در دیوان بین‌المللی دادگستری، دیوان کیفری بین‌المللی و سازمان بین‌المللی هوانوردی کشوری.
- برگزاری مراسم سالانه‌ی یادبود برای گرامیداشت یاد جانباختگان و درخواست از دولت برای ادامه‌ی پیگیریِ حقیقت.
- برگزاری راهپیمایی‌هایی با حضور هزاران نفر برای مطالبه‌ی اقدامات لازم.
- راه‌اندازی کارزارهای آنلاین و تهیه‌ی گزارش‌‌، نوشتن کتاب‌، تولید فیلم‌ مستند و کمک به ارائه‌ی دادخواست‌های حقوقی.
- همکاری با دیده‌بان حقوق بشر و سازمان ملل متحد.
- انتشار یک گزارش جامع و دقیق درباره‌ی این فاجعه.
- اجرای یک کارزار موفق برای وادار کردن دولت کانادا به اعلام رسمی سپاه پاسداران انقلاب اسلامی به عنوان یک نهاد تروریستی.
- راه‌اندازی یک وب‌سایت جامع، شامل صفحاتی اختصاصی برای جانباختگان، که با همکاری خانواده‌های آنان، برای ادای احترام شایسته به عزیزان از دست‌رفته‌شان تهیه شده است.

از نظر من، تصمیمات هیئت مدیره در مورد نحوه‌ی دستیابی انجمن به اهدافش و تصمیم برای عدم ارائه‌ی حمایت مالی مستقیمی که مهرزاد درخواست کرده است، تفسیری منطقی است که در چارچوب قانون داوری تجاری قرار می‌گیرد و شایسته‌ی احترام است.»

قاضی در مورد فعالیت حزبی یا غیرحزبی انجمن در کانادا چنین می‌نویسد:

«اگرچه مطالب مهرزاد به‌طور صریح ادعا می‌کنند که اعضای هیئت‌مدیره دارای جاه‌طلبی‌های سیاسی هستند
